OSSALMA FZCO website allows users to receive information about OSSALMA and/or any of its services, products, subsidiaries if any (including e-mail newsletters, direct messaging, advertising) interact with other members or visitors to the OSSALMA website, and book, cancel and pay for services offered at OSSALMA facilities. The services (OSSALMA FZCO Services) offered by OSSALMA FZCO include but are not limited to the www.ossalma.com website, which is hosted in the United Arab Emirates.
 

"OSSALMA FZCO" is referred to OSSALMA, www.ossalma.com and/or any of the owners, employees, staff and/or representative of OSSALMA FZCO.

“Buyer, User, I and/or You” is referred to any personnel buying and/or using any of OSSALMA FZCO services, activities, programs and/or products of any kind including and not limited to, fitness activities, consultations, advices, challenges programs, activities, nutrition plan, playing, practicing, training, traveling, or otherwise participating in any of OSSALMA’s programs and/or services.
 

“3rd Party” is referred to any activity, service, program and/or products including and not limited to fitness activities, consultations, advices, challenges programs, activities, nutrition plan, playing, practicing, training, traveling provided by any entity outside and not part of OSSALMA FZCO.
 

These terms and conditions ("Terms of Service") set forth the legally binding terms for your use of OSSALMA FZCO Services. By using OSSALMA FZCO Services, you agree to be bound by these Terms of Service, whether you are a "Visitor" (which means that you simply browse OSSALMA FZCO website) or you are a "Member" (which means that you have registered with OSSALMA FZCO and/or purchased one or more OSSALMA FZCO Services). The term "User" refers to a Visitor or a Member. You are only authorized to use OSSALMA FZCO Services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to these Terms of Service. Please read these Terms of Service carefully and save it. If you do not agree with it, you should leave OSSALMA website and discontinue use of OSSALMA Services immediately. Nothing in these Terms of Service shall be deemed to confer any third-party rights or benefits.

Waiver

By purchasing any service, package and/or product from OSSALMA FZCO, you are automatically agreeing to waive any and all claims that you might have against OSSALMA FZCO or any employee, owner, staff and/or representative of OSSALMA FZCO or OSSALMA FZCO Subsidiaries arising out of any physical, mental and/or emotional injury or damage sustained by buyer and/or user while following any of OSSALMA FZCO fitness activities, consultations, advices, challenges programs, activities, nutrition plan, playing, practicing, training, traveling, or otherwise participating in any of OSSALMA’s programs and/or services including 3rd party that may include physical, health, mental and/or emotional risks. You hereby acknowledge that you're physically, mentally & emotionally capable of participation in any of OSSALMA FZCO fitness activities, consultations, advices, challenges programs, activities, nutrition plan, playing, practicing, training, traveling, or otherwise participating in any of OSSALMA’s programs and/or 3rd party that may include physical, health, mental and/or emotional risks. You hereby take any and all responsibilities for following OSSALMA FZCO nutrition plan, purchasing, participating, training, traveling or playing in any of OSSALMA FZCO or OSSALMA FZCO Subsidiaries programs and/or services including and not limited to 3rd party. You consent that any and all information you have provided are genuine and true. You hereby acknowledge & confirm that you will not share any program or information received or purchased by/from OSSALMA FZCO or OSSALMA’ FZCO Subsidiaries as well as maintain and respect their privacy in addition to their terms & conditions provided on OSSALMA FZCO website www.ossalma.com and/or any of OSSALMA FZCO owners, employees, staff and/or representatives.
 

 OSSALMA FZCO WEBSITE

These Terms of Service apply to all Users of OSSALMA FZCO website. OSSALMA FZCO website may contain links to third party websites that are not owned or controlled by OSSALMA FZCO. OSSALMA FZCO has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites, including privacy and data gathering practices. In addition, OSSALMA FZCO will not and cannot censor or edit the content of any third-party site. By using the website, you expressly relieve and release OSSALMA FZCO from any and all liability arising from your use of any third party website.

Accordingly, we encourage you to be aware when you leave OSSALMA FZCO website and to read the terms and conditions and privacy policy of each other website that you visit. Upon leaving OSSALMA FZCO website these Terms of Service shall no longer govern.
 

OSSALMA CONTENT

OSSALMA FZCO content is a private entity owned by OSSALMA FZCO, any content including "Pictures, Videos, Programs" on this website and/or social media including "Facebook, Instagram, Twitter" should not be recorded, screenshot, screen recorded or shared.

Among the types of Personal Data that this Website collects, by itself or through third parties, there are: Cookies; Usage Data; unique device identifiers for advertising (Google Advertiser ID or IDFA, for example).

Cancellations, Refund and Return Policy:

OSSALMA FZCO reserves all the rights to cancel, postpone or re-schedule Virtual and/or Gym challenges/sessions/courses including not limited to low enrolment or unforeseen circumstances, past, current and/or future pandemics like COVID-19 and/or otherwise, natural disaster, medical illness and/or financial crisis. All mentioned are strictly included in the No Refund, No Return and No Transfer Policy.

All Services including not limited to Packages, Challenges, Programs, Retreats, Fitcations purchased from OSSALMA FZCO and/or any of OSSALMA FZCO Services  www.ossalma.com OSSALMA Virtual Classes, Virtual Challenges, OSSALMA Retreats, OSSALMA Fitcation, OSSALMA His Training Spot, OSSALMA Her Training Spot" are non-refundable, non-transferable, non-extendable. 

WE STRICTLY HAVE NO-REFUND, NO-RETURN, NO-TRANSFER POLICY ON ALL SERVICES PROVIDED, PURCHASED AND/OR USED.

Cancellation:

In the event of a client cancellation, OSSALMA FZCO will not refund the membership fee for any sold service, package, program, challenge virtually or gym classes. OSSALMA FZCO cannot accept and/or bear responsibility nor expenses for changes occurring from the clients' end. 

Non Attendance (No Show):

OSSALMA FZCO cannot accept and/or bear responsibility nor expenses for changes occurring from the clients' end.

OSSALMA FZCO reserves all the rights to cancel, postpone or re-schedule Virtual and/or Gym challenges/sessions/courses including but not limited to low enrolment or unforeseen circumstances, past, current and/or future pandemics, natural disaster, medical illness and/or financial crisis. This is strictly included in the No Refund, No Return Policy.

NO-REFUND, NO-RETRUN and NO-TRANSFER POLICY APPLIES 

• If a client is not able to finish the membership cycle due to circumstances beyond their control, OSSALMA will offer the client the option to attend another sessions if applicable with the remaining unused service. Examples of circumstances beyond the control of the client include serious illness or accidents, THIS IS NOT APPLICABLE ON OSSALMA Retreats Services.

• No refund will be made to clients who do not attend classes or do not finish his/her membership duration.

Every effort is made to ensure the accuracy of the information on the website; it may be subject to later alteration or amendment in the light of policy changes, cycle updates or other constraints.

Cancellations, Refund and Return Policy:

OSSALMA FZCO reserves all the rights to cancel, postpone or re-schedule the retreat including not limited to low enrolment or unforeseen circumstances, past, current and/or future pandemics like COVID-19 and/or otherwise, natural disaster, medical illness and/or financial crisis. All mentioned are strictly included in the No Refund, No Return and No Transfer Policy.

Cancellation:

In the event of a client cancellation, OSSALMA FZCO will not refund, return nor transfer the package fee.

OSSALMA FZCO cannot accept and/or bear responsibility nor expenses for changes occurring from the clients' end. 

OSSALMA Retreats is an OSSALMA FZCO service and the following terms apply to all life style development consultancy programs, sporting activities and sporting services:

• If OSSALMA FZCO announced a cancellation of any program, the participant will be refunded the fee.

• All deposits are non-refundable, unless the program is cancelled by OSSALMA FZCO.

• Upon OSSALMA FZCO payment to third party vendors, the full amount is non-refundable unless a refund can be garnered from third party vendors. In this case, the deposit remains non-refundable.

• Every effort will be made to ensure the program is adhered to. If activities are cancelled out of OSSALMA FZCO control, a refund will not be applicable unless and/or until a refund from third party vendors is garnered. 

• Any cancellation due to severe medical condition backed up with an authorized medical report that states the condition is not eligible for travel, the client will be refunded the remaining amount of the package fee “If full amount was paid by the client”, excluding the deposit, deposits are none-refundable with no exception.

• There is no exception to cancellation policy including whether or personal emergencies, flight cancellations or delays.

• We recommend purchasing Travel Protection Insurance through a qualified agent.

The information provided by OSSALMA FZCO is correct at the time of publication but may be subject to change. OSSALMA FZCO reserves the right to change packages fees, dates and coaches at its discretion

OSSALMA FZCO ACCOUNTS

In order to access some features of the website, you will have to create a OSSALMA FZCO account. You may never use another person account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify OSSALMA FZCO immediately of any breach of security or unauthorized use of your account.

 If you enter, register and/or view Ladies Only sessions, classes and/or retreats using any medium Virtual and/or physical, memberships and/or packages, you MUST be of the same gender, Female. You are not allowed/permitted under any circumstances to interact, register, view and/or attend Ladies Only sessions, classes and/or retreats at any medium used Virtual and/or physical. Otherwise, you will immediately legally reported with respect your regions legal authorities.

 Any type of communication between OSSALMA FZCO and/or its subsidiaries with the user, must kept confidential at all times. No data is allowed to be shared, including Workout programs, schedules, diet and nutrition plans, demo videos, pictures or script

 Although OSSALMA FZCO will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of OSSALMA FZCO or others due to such unauthorized use.

 GENERAL TERMS

 ELIGIBILITY

Membership is void where prohibited. This website is intended solely for Users who are 13 years of age or older. Any registration by, use of or access to the website by anyone under 13 is unauthorized, unlicensed and in violation of these Terms of Use. By using OSSALMA Services or the website, you represent and warrant that you are 13 or older and that you agree to abide by all of the terms and conditions of these Terms of Service. Minors between the ages of 13 and 18 may register on our website only with the involvement of a parent or guardian.

TERM

These Terms of Service shall remain in full force and effect while you use OSSALMA Services or are a Member. You may terminate your membership at any time, for any reason, by following the instructions on the "My Account" page. OSSALMA may terminate your membership at any time, without warning, if you breach these Terms of Service. Even after membership is terminated, these Terms of Service will remain in effect.

FEES

You acknowledge that OSSALMA charges fees for its services, and OSSALMA reserves the right to change its fees from time to time in its discretion. If OSSALMA terminates your membership because you have breached these Terms of Service, you may not be entitled to a refund of any unused portion of membership or other fees.

PASSWORD

When you sign up to become a member, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another member at any time or to disclose your password to any third party. You agree to notify OSSALMA immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.

GENERAL USE OF THE WEBSITE PERMISSIONS AND RESTRICTIONS

OSSALMA hereby grants you permission to access and use the website as set forth in these Terms of Service, provided that you agree not to distribute in any medium any part of the website, without OSSALMA prior written authorization and you agree not to alter or modify any part of the website or any of its related technologies.

 You will otherwise comply with the terms and conditions of these Terms of Service and all applicable local, national, and international laws and regulations.

OSSALMA trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without the prior written permission of OSSALMA.

MOBILE SERVICES

The OSSALMA Services may include certain services that may be available via your mobile phone, including but not limited to (i) the ability to book and/or purchase OSSALMA Services via your mobile phone, (ii) the ability to receive and reply to OSSALMA messages, (iii) the ability to browse OSSALMA from your mobile phone and (iv) the ability to access certain OSSALMA features through a mobile application you have downloaded and installed on your mobile phone (collectively the "Mobile Services"). We do not charge for these Mobile Services. However, your carrier's normal messaging, data and other rates and fees will still apply. Indemnity You agree to defend, indemnify and hold harmless OSSALMA, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the OSSALMA website or your violation of any term of these Terms of Service. ABILITY TO ACCEPT TERMS OF SERVICE

 ASSIGNMENT

These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by OSSALMA without restriction.

GOVERNING LAW; VENUE AND JURISDICTION

You agree that: (i) OSSALMA website shall be deemed solely based in Dubai; and (ii) OSSALMA website shall be deemed a passive website that does not give rise to personal jurisdiction over OSSALMA, either specific or general, in jurisdictions other than Dubai. These Terms of Service shall be governed by the internal substantive laws of the City of Dubai, without respect to its conflict of laws principles. Any claim or dispute between you and OSSALMA that arises in whole or in part from OSSALMA website shall be decided exclusively by a court of competent jurisdiction located in Dubai, UAE and you hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non convenience with respect to, venue and jurisdiction in the state and federal courts of Dubai.

 These Terms of Service, together with the Privacy Policy (located at www.ossalma.com and any other legal notices published by OSSALMA on the website, shall constitute the entire agreement between you and OSSALMA concerning OSSALMA website. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. No waiver of any term of these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and OSSALMA failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision. OSSALMA reserves the right to amend these Terms of Service at any time and without notice, and it is your responsibility to review these Terms of Service for any changes. Your use of OSSALMA website following any amendment of these Terms of Service will signify your assent to and acceptance of its revised terms. YOU AND OSSALMA AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO OSSALMA WEBSITE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

 ARBITRATION

Any controversy, claim or dispute arising out of or relating to these Terms of Service will be referred to and finally settled by private and confidential binding arbitration before a single arbitrator held in Dubai, UAE in English and governed by Dubai law pursuant to the Rules of Commercial Conciliation and Arbitration of 1994 (Dubai), as amended, replaced or re-enacted from time to time. The arbitrator shall be a person who is legally trained and who has experience in the information technology field in Dubai and is independent of either party. Notwithstanding the foregoing, the Site reserves the right to pursue the protection of intellectual property rights and confidential information through injunctive or other equitable relief through the courts.

 SUBMISSIONS

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the OSSALMA website or OSSALMA Services, provided by you to OSSALMA are non-confidential and shall become the sole property of OSSALMA. OSSALMA shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of such information for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

Once you purchase, any package, service and/or product you are automatically agreeing to the below clause:

You, hereby, waive any and all claims by purchasing any service, package and/or product from OSSALMA FZCO, you are automatically agreeing to waive any and all claims that you might have against OSSALMA FZCO or any employee, owner, staff and/or representative of OSSALMA FZCO or OSSALMA FZCO Subsidiaries arising out of any physical, mental and/or emotional injury or damage sustained by buyer and/or user while following any of OSSALMA FZCO fitness activities, consultations, advices, challenges programs, activities, nutrition plan, playing, practicing, training, traveling, or otherwise participating in any of OSSALMA’s programs and/or services including 3rd party that may include physical, health, mental and/or emotional risks. You hereby acknowledge that you're physically, mentally & emotionally capable of participation in any of OSSALMA FZCO fitness activities, consultations, advices, challenges programs, activities, nutrition plan, playing, practicing, training, traveling, or otherwise participating in any of OSSALMA’s programs and/or 3rd party that may include physical, health, mental and/or emotional risks. You hereby take any and all responsibilities for following OSSALMA FZCO nutrition plan, purchasing, participating, training, traveling or playing in any of OSSALMA FZCO or OSSALMA FZCO Subsidiaries programs and/or services including and not limited to 3rd party. You consent that any and all information you have provided are genuine and true. You hereby acknowledge & confirm that you will not share any program or information received or purchased by/from OSSALMA FZCO or OSSALMA’ FZCO Subsidiaries as well as maintain and respect their privacy in addition to their terms & conditions provided on OSSALMA FZCO website www.ossalma.com and/or any of OSSALMA FZCO owners, employees, staff and/or representatives.
